By accessing or using the Hyper Baddies website and services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

2. Description of Service

Hyper Baddies provides a waitlist signup service for users interested in our upcoming DeFi community platform on Hyperliquid. The Service currently includes:

• Waitlist registration
• Email updates and notifications
• Optional wallet connection and verification
• Community information

3. Eligibility

You must be at least 18 years old to use our Service. By using the Service, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into these Terms
• You will provide accurate and truthful information
• You will comply with all applicable laws and regulations

4. User Accounts and Registration

4.1 Waitlist Signup

When you sign up for our waitlist, you agree to:

• Provide accurate and current email address
• Maintain the security of your account information
• Not impersonate others or provide false information
• Not create multiple accounts for the same person

4.2 Wallet Connection (Optional)

If you choose to connect your cryptocurrency wallet, you acknowledge and agree that:

• Voluntary Connection: Wallet connection is entirely optional and not required for waitlist signup
• Verification Only: We only request a signature to verify you own the wallet address
• No Access to Funds: We cannot and will not access, transfer, or control your funds
• No Private Keys: We never request, store, or have access to your private keys
• Read-Only: The connection is read-only with no transaction permissions
• Public Data: Wallet addresses are public blockchain information
• Your Responsibility: You are solely responsible for the security of your wallet and private keys
• Third-Party Wallets: We are not responsible for the security or functionality of third-party wallet providers (MetaMask, etc.)

4.2 Account Termination

We reserve the right to suspend or terminate your access to the Service if you violate these Terms or engage in fraudulent or abusive behavior.

5. Acceptable Use

You agree NOT to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Use automated systems (bots) to sign up multiple times
• Transmit viruses, malware, or harmful code
• Harass, abuse, or harm other users
• Violate any applicable laws or regulations
• Scrape or collect data from the Service without permission

6. Intellectual Property

6.1 Our Content

All content on the Service, including text, graphics, logos, images, and software, is the property of Hyper Baddies or its licensors and is protected by copyright, trademark, and other intellectual property laws.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes.

• Accuracy or completeness of content

8.2 No Liability for Losses

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HYPER BADDIES SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Damages arising from your use or inability to use the Service
• Any cryptocurrency or financial losses
• Actions of third parties

8.3 Limitation of Liability

In no event shall our total liability exceed $100 USD or the amount you paid us (if any) in the past 12 months, whichever is less.

9. Indemnification

You agree to indemnify, defend, and hold harmless Hyper Baddies, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of applicable laws

10. Third-Party Services

Our Service uses third-party services including:

• Google reCAPTCHA: Subject to Google's Terms of Service
• Google Sheets/Apps Script: For data storage
• Hyperliquid: Future integration (separate terms will apply)

We are not responsible for third-party services and their terms apply separately.

11. Modifications to Service and Terms

11.1 Service Changes

We reserve the right to modify, suspend, or discontinue the Service at any time without notice.

11.2 Terms Changes

We may update these Terms from time to time. Material changes will be notified via:

• Email to registered users
• Notice on our website
• Updated "Last Updated" date

Continued use of the Service after changes constitutes acceptance of the new Terms.

12. Termination

12.1 By You

You may stop using the Service at any time and request deletion of your data by contacting us.

We may terminate or suspend your access immediately, without notice, for:

• Fraudulent or illegal activity
• Abusive behavior

13. Dispute Resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting us at legal@hyperbaddies.xyz.

13.2 Arbitration

Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with applicable arbitration rules, except where prohibited by law.

13.3 Class Action Waiver

You agree to resolve disputes on an individual basis and waive any right to participate in class action lawsuits, except where prohibited by law.

14. Governing Law and Jurisdiction
